2. paimaiasia.com is Only a Marketplace. paimaiasia.com acts as an online marketplace for sellers of items to display their products/services and for buyers to find items of interest to them. paimaiasia.com is not involved in the actual transaction between buyers and sellers unless paimaiasia.com is a seller of a particular auction item. As such, paimaiasia.com has no control over the accuracy of the representations made by non-paimaiasia.com sellers of items listed on the site. paimaiasia.com cannot provide any assurance for whether successful auctions will ultimately be consummated with an exchange of consideration for products or services.

   To deter the occurrence of fraud on our Web site, paimaiasia.com practices a very strict policy of removal toward reported events of fraud or an extreme number of negative customer feedback. Unless items are arranged (by sellers and buyers) to be authenticated, there is great difficulty in authenticating some claims of sellers. To avoid fraud, paimaiasia.com members must be careful in selecting and bidding on items of interest. We strongly recommend that potential buyers contact sellers through paimaiasia.com's e-mail correspondence site features to ask key questions or gather additional information of their auction of interest.

   paimaiasia.com reserves the right to cancel any auctions of items deemed by paimaiasia.com to be offensive, illegal or inappropriate for our Web site.

3. Fees and Fee Schedule. Membership with paimaiasia.com is free. -All fees and charges are denominated in Singapore Dollars (SG$) unless otherwise specified. You are responsible for paying all relevant duties, taxes and other charges that are incurred through the bidding, listing, or selling process.

4. Listing and Selling Items. paimaiasia.com members list items for sale on our Web site by selecting the desired category under which the listing will appear. An item listing is composed of seller-selected auction criteria such as auction end date, acceptable payment methods, auction format, text descriptions of the item, and any internet links to additional information such as images. paimaiasia.com members sell items through having listed auction items successfully bid upon by potential buying paimaiasia.com members. Winning bidder information will be e-mailed to the seller upon completion of the auction.

   You may not try to enhance your own auction's outcome by contacting other bidders of a currently active auction being conducted by a different seller, offering similar or identical items, nor may you use another member account to personally place bids on your own items, for any reason.

   paimaiasia.com MAY, AT ITS SOLE DISCRETION, IMMEDIATELY TERMINATE YOUR ACCOUNT IF YOU ARE FOUND TO HAVE ENGAGED IN ANY FORM OF FRAUDULENT ACTIVITY IN CONNECTION WITH OUR WEBSITE.

5. Bidding and Buying Items. A winning bidder is defined as a bidder that has the highest bid that exceeds any minimum bid or reserve price specified by the seller of a completed auction. Winning bidders of auctioned items are obligated to consummate transactions with sellers. You may not manipulate an auction with unfair intent. Bids for items of adult content may only be made by entities qualified under applicable law. For example, persons of age under 18 are under no circumstances allowed to bid on items with adult content. A winning bidder is obligated to buy the completed auction item. Purchases must be made through either one of the auction item-specified acceptable payment terms or through a method agreed upon by the seller.

   IF ANY INFORMATION THAT YOU PROVIDE IS INCOMPLETE OR INACCURATE, paimaiasia.com RETAINS THE RIGHT IMMEDIATELY TO TERMINATE YOUR MEMBERSHIP AND YOUR RIGHTS TO USE THE SITE.

6. Compliance with Laws. You agree to comply with all applicable laws, statutes and regulations regarding use of the Services, including in regard to bidding, listing, purchasing and selling items.

7. Special Admonitions for International Use. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptability of listing items. Specifically, you agree to comply with all applicable laws regarding the sale and purchase of items exported from Singapore or the country in which you reside.

9. Member Conduct. Each paimaiasia.com member agrees to act in a manner that does not violate any laws of the Singapore. Members must list items for sale that are legal for export and comply with Singapore laws relating to the transmission of sensitive technical data. You must not act in a manner that misrepresents the information you provide to other members. Specifically, your information and sale of your items through our Services shall not: (i) involve fraudulent, counterfeit or stolen items; (ii) infringe any patent, trademark, copyright or other intellectual rights and; (iii) violate any law, statute, ordinance or regulation in the HK or the country in which you reside.

   You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials whether publicly posted or privately transmitted, are the sole responsibility of the person which such transmission originated. Under no circumstances will paimaiasia.com be liable in any way for any transmission by paimaiasia.com members. Members may not manipulate auctions through placing bids through other paimaiasia.com accounts.

10. System Reliability. paimaiasia.com will make its best efforts to ensure that our system is reliable. You may not in any way act in a manner as to cause our site and resources to be overloaded. You must not reveal your password or promotion codes to other persons or businesses.

11. Member Feedback. You must give true and accurate feedback on other members. You must not use our feedback system to unfairly degrade the status of others. Our feedback is provided as an additional service to members and as such should be used only in appropriate circumstances. Realizing everyone's judgement varies, subjective comments over others should be given with a fair level of tolerance. paimaiasia.com WILL REMOVE ANY MEMBER CAUGHT USING SUCH TACTICS.

12. Disputes. Because paimaiasia.com is not involved in the actual transaction between Sellers and Buyers and is not the agent of either for any purpose, paimaiasia.com will not be involved in resolving any disputes between participants related to or arising out of any transaction. paimaiasia.com urges Sellers and Buyers to cooperate with each other to resolve such disputes.

13. License. By entering into this Membership Agreement and listing an item, you grant paimaiasia.com a non-exclusive, world-wide, royalty-free, irrevocable, right to exercise all copyright and rights of publicity over the material displayed in your listings or bids, in any existing or future media, known or unknown, now or at any later date.

    paimaiasia.com grants a limited license to each participant to make personal use only of the Site and the Services. This license expressly excludes, without limitation, any resale or commercial use of the Site and the Services, making any derivative of the Site or the Services, the collection and use of participant email addresses or other participant information, ratings or listings, or any data extraction or data mining whatsoever.

14. Member Feedback. You must give true and accurate feedback on other members. You must not use our feedback system to unfairly degrade the status of others. Our feedback is provided as an additional service to members and as such should be used only in appropriate.

15. Indemnity. You agree to indemnify and hold paimaiasia.com, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your information, data, text, software, music, sound, photographs, graphics, video, messages or other materials or use of the site.

    paimaiasia.com MAKES NO WARRANTY REGARDING ANY ITEMS PURCHASED OR OBTAINED THROUGH THE WEBSITE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE WEBSITE.

16. No Warranties. THE paimaiasia.com WEB SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION. paimaiasia.com EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO:

    (a) THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING.

    (b) ANY REPRESENTATIONS THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE.

    (c) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE.

17. General Release. BECAUSE paimaiasia.com IS NOT INVOLVED IN TRANSACTIONS BETWEEN BUYERS AND SELLERS OR OTHER PARTICIPANT DEALINGS, IF A DISPUTE ARISES BETWEEN ONE OR MORE PARTICIPANTS, EACH OF YOU RELEASE paimaiasia.com (AND ITS AGENTS AND EMPLOYEES) FROM CLAIMS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, SUSPECTED AND UNSUSPECTED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES.

18. Limitation of Liability. paimaiasia.com SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE User Agreement, THE USE OR THE INABILITY TO USE THE WEBSITE, THE SERVICES PROVIDED BY paimaiasia.com OR INABILITY TO THE USE THE SERVICES PROVIDED BY paimaiasia.com, OR THOSE RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICES.

19. Termination. paimaiasia.com RESERVES THE RIGHT TO TERMINATE THIS User Agreement, ACCESS TO ITS WEB SITE OR SERVICES, ANY CURRENT AUCTIONS WITHOUT ANY NOTICE FOR ANY REASON.
